In criminal cases?can prosecutor be from private counsel or the state just appoint them?

so when the state appoints it?who actually pays for the service the state or the complainant? The state prosecutes crimes. You can hire a lawyer if you want, however the lawyer will not be able to participate in the prosecution of the case.





You could however hire a lawyer to file a civil action against the perpetrator of the crime to recover any damages you have suffered.

They are pretty good especially if you don't want to change the color of your phone. It keeps it protected. I got mine from Radio Shack about 2 months ago and it is of really good quality...I have already dropped it a couple of times. I don't know what brand my is because I had opened the package as soon as I got it and it does not have any words on it. It was about $16. Happy Holidays

After all the statements have been taken.They are sent to the DPP(The Department Of Public Prosecutions). They then look at the statements and evidence. They make a decision on what they have to see if it will go to court.


If it goes to court the victim has the DPP to represent them. The accused has there own solicitor. It is normally held in a closed court(this means no jury just a judge a police officer somebody who is taking the notes.the victim the a member of the DPP the accused there solicitor and anybody who has made statements.)


Then the Judge will decide on what will happen.





It's just one persons word against the the others.I was raped and in the middle of this process at the moment. And I realize a lot of people make false statements and I think that's disgusting. Best thing is to write down on a piece of paper before having sex that you both agree to have sex and date it and sign it!!! Ha ha ha. I'm afraid some day we'll go to this length. In the meanwhile if a woman looks injured when she gets examined by a doctor this is evidence of struggle. If there are no signs of struggle or injury and she is calm then who would believe her? In case of rape there must be struggle and it will be obvious if the victim is still alive. Also there can be DNA testing to identify the fluids in the victim's vagina. This can really incriminate the perpetrator.
On the issue of consent, yes we face the all too difficult position of he said she said. However as is often the case the victim is heavily intoxicated, in law they are unable to form the requisite capacity to consent and thus anything that the offender does to her is rape.





In so far as determining if something did in fact happen then we are forced to rely of forensic evidence and the medical examination of the victim. This is also fraught with issues in that the victim often feels that they're being raped again by the examining doctor.





Far too many rapes go unreported for a whole variety of reason.... shane, fear of retribution, shock, self loathing etc. Sadly far to many non rapes also get reported and this makes it difficult for police investigators to determine what is real and what is not. Police will balance the version provided by the complainant against the evidence to hand ... its all we have when working out the truth of the matter.





In my 10 years of experience I have investigated and assisted in the investigation of many rapes ..... far too many have in fact come down to what is politely described as 'post coital remorse' or ';what happens when my partner finds out?'; and the rape complaint is seen as the only way out.





I can say that all matters are treated as real and as rapes until proved otherwise and all are referred onto sexual assault services and counseling.





If anyone reading this is in the position of being the victim of an unreported rape, any police officer worthy of their badge will help you as best they can. A late complaint of rape is not always too late (a little more difficult granted, but not impossible)



Sadly enough, many people get off the hook if there is no solid evidence of rape. They may look at the reactions of the woman when being interviewed by police and lawyers and such, but there is no way of determining whether or not someone was raped with no evidence or witnesses.
If semen is present, it not only proves that sex happened, it can be DNA typed to match a specific person.





If a rape kit is ran, they can tell by the vaginal bruising (or anal bruising in some cases) if it is consensual sex or not...there is a ';sex clock'; standard...if bruising occurs at certain points on the ';clock'; is can show it was consensual or rape.





If no rape kit and after the fact, the perp will be tried via circumstantial evidence...if there are a multitude of other women that were taken advantage of, it could be proven and the perp convicted circumstantially.
The 'authorities' don't. In a trial, witnesses are presented and lawyers will attempt to sway the jury's opinions, but it is the jury that ultimately decides whether or not the victim is telling the truth.





Edit - However, this assumes that the matter even goes to trial. Sadly, these things often don't.

    It isn't really proof of much at all. Basically what it means is that the majority of rape cases don't have enough evidence to prove guilt beyond any reasonable doubt. The judicial system in the UK is designed to favour the accused by requiring a very high standard of proof in order to result in a conviction. Rape is often a difficult thing to prove to that standard.


    Of course this is terribly unjust, but what can really be done about it? You can't simply lower the standard of proof, since if a man is falsely accused of rape (and I don't believe that to be a particularly common scenario, but it does happen) then there would be a good chance of his being punished for a crime he didn't commit.
    Until men stand up to men who rape men, women and children, and say rape is wrong and won't be tolerated under any circumstances, rape will continue. Look at how many people are justifying all rape because some are false accusations. So is all murder ok too, since some people are falsely accused of murder? Just why do so many of these people identify with the ones being accused of rape? It makes you wonder just what they are so worried about. Yep, the western world is still very patriarchal. A man's word still counts more than a woman's.
    Rape is a hard thing to prove. Since you need proof beyond a reasonable doubt to convict someone of a crime, that's why there are so few convictions.

    I'd be curious to know the difference between the conviction rates for male/female victims. Seems like when there's a male victim, the entire world pays attention and the court system is inclined to pursue all avenues that ';justice is done';

    I know for a fact its very hard to prove rape. Part of it is to protect the attacker from false accusations. I'm divided on the issue. There are many cases where the attacker walks away without so much as a slap on the wrist. I know of one such case personally. But, at the same time, we shouldn't make it so easy to convict a person based on accusation that innocent people are sent to jail.





    Proving most rapes is often very hard because it comes down to ';he said-she said';. Personally, I don't see how they can change the standards without risking innocent people. While I agree that the percentage of false accusations are not near as high as some of the people on the forum will try to make it, we have to be aware that, yes, there are some people out there who will make false accusations.





    Unfortunately, its just a situation that seems to have no remedy.





    Some things that have helped, however, is that when on trail they can not bring up your attire during the attack or your past history. Small steps like this is at least helping women gain the courage to come forward after an attack. This way they don't feel like they'll be attacked again while on the stand (which, of course, happens anyway).
    I don't know why men think and speak highly of their gender, they are the rapists, murderers, theives, bombers, home-wreckers, unfaithfuls, abusers, even the students who have gone in shootings are all males! God's gift to women? yeah right.





    Oh and to answer your question, they may get away with the law of men but the Law of God they will never escape.





    Edit: in regards to those questioning whether the case was reported; I know of 3 people who reported their case to the court and let me tell ya, they lost okay? All 3 of them. One of them, molested by a relative when she was only a child testified in court as a teenager and she LOST THE CASE okay? do you get that? The judge did say she believed the child but there was not enough evidence... she was a child.

    What is comes down to is a weight measure.. The judges and juries on one hand measure the value of the victim/survivor, a mere woman, and her future value to society, against her perceived damage. The life-long damage that rape causes to the woman, her future spouse(s), and her children is severely under-valued. Even in this forum, men have acknowledged that they think that rape is no more than an unwanted sexual experience and do not even understand the extreme physical pain involved, much less the unending, and unmendable emotional scars.


    Against that side, they measure the accused, and man, who is perceived to be far more valuable to society for the contributions that he may make in the future, and weighed against that are the damages that he will endure if convicted, meaning a certain amount of years in jail, and the loss of what he would have contributed to society if he was free.


    WIth that in mind, you will only have a conviction if the woman is from a good family, and educated, having a future of great contribution to society, and if the male is of low-breeding, and has little or no education, and is not expeced to contribute much to society. That accounts for the low conviction rate.


    The idea that it has anything to do with the testimony at trial, or the guilt or innocence of the accused is a myth. The same thing is true for murder. It is not about guilt or innocence, but about who you murder, and who is accused of murder. If the accused is brought to trial for murdering someone more valuable to society that he/she is, they will probably be found guilty. This helps explain the large percentage of minorities in prison.


    This is based on many jurisprudence studies done in the US, but I suspect that the same thing holds true for the UK, since both societies are very class conscious.
    I'm not so sure that it is patriarchy that dictates this statistic. Rape cases are generally hard to prove if there is no physical evidence such as spermal (is that a word? LOL) DNA. But I would say that it is still widely believed that a rape victim has somehow done something to deserve what happened.

    In Canada the victim serves as evidence. Nobody represents her and to actually go through with a trial is revictimizing her and forcing her to relive the trauma again and again.     Note that in both studies, you get high numbers just from recantations by the women, it is logical to presume that not all the false claimants recanted, so the percentage of false claims MUST be higher than the 27% and 41% figures.


    Note, as well, that the law rarely sanctions false claimants, thus making further false claims all the more likely.


    See also the Duke Lacrosse team rape case, which did a LOT of damage to innocent men, yet resulted in only one day in jail for the rogue prosecutor, and none for the false claimant. Let us know when the conviction rate of false claimants comes UP to 6%...

    There are no ';federal lawyers.'; Lawyers get licensed to practice before a particular federal court. Look for the website for the state bar association where the prison is. Find one that is licensed to practice in the US District Court for the area where the prison is located.

    For me, I think it's VERY important to share religious views. I love my God and my Lord, so it only makes sense to stay with someone who also share the same passion.     I actually agree with the first two people and believe me, I don't panic when things like this go around. My 24 year old daughter is also pregnant (only 5 months right now though) and I worry about her too. Your immune system is lower when you're pregnant and it's just not worth the risk. Also, call your child's doctor on Monday to see if they feel you should bring her in just in case too.

    Fair or not, we KNOW some people are guilty and that means they shouldn't have any defense.     He could avoid a trial by pleading guilty of all charges. Then it would be up to a judge to impose his sentence.


    But that sort of thing usually comes from some kind of plea bargaining for a reduced sentence, and no prosecutor is going to want that.     We need to uncover the truth about what happened.Knowing that he is guilty is not enough. We need to see the evidence so that we can see exactly what he has done, even though the defense may try and twist the facts to get him off - that's their job.


    The other side of the coin is that sometimes we 'know' someone is guilty because they fit the profile, and are not a very nice person anyway and may even have done similar crimes, but in a particular case might be innocent. If we just convict without trial there would be many more miscarriages of justice than there are with the jury system. Also who are we going to appoint to decide? The present system is flawed, but it's probably the best of a bad lot. There's no perfect solution, I'm afraid.

This man raped a women before his daughter, was only given 18 months for it, got to adopt kids the same gender as the women he raped which i think is really sick, has his criminal record removed after only five years, since his daughter ran away twice b4 the dungeon episode was returned to her family by the police ( if his criminal record had been available) maybe this wouldnt have happened. and is allowed to build a dungeon like cellar if a rapist told me he wanted to build a sound proof room underground i certainly wouldn't think his intentions were good. didn't have his privacy invaded. since clearly rapists have a right to privacy too must be what the austrian authorities think. yeah right privacy to hurt and torture people. sadly this is another case of authorities being to lenient with people. i mean if one was austrian and raped somone at 20 the most one would get is 15 years (yes its completely shocking that the maximum sentence in austria is 15 years for sex crimes) this person would be out at 35 at most by which time they would have learnt that the next time they must do it so that they do not get caught. i think people all over the world should start protesting about these ';enabling laws'; that enable perpertrators of these crimes to get away with their deeds until they do something really horrific. i mean its happening everywhere all over the world time and time again you here some peadophile has done something really awful killed, raped or tortured children and then you hear but wait this guy had a previous conviction for a similar crime before he did this terrible thing and was given a light slap on the wrist the first time. if any good is to come out of this the authorities and law makers of the world will start waking up and realising if they jail these people the first time for lengthy periods in order for justice to the original victims as well as preventing future victims. why are laws being made for pedophiles. i mean its like the average pedophile gets to hurt at least two or three kids before he actually gets a tough sentence. and as for the daughter she was raped from the age of 11, ran away twice and was returned home to her parents by the police, was drugged, made to give birth without any medical care or attention. the poor women was probably mentally and physically exhausted, that she managed to last that long without dying is a tribute to her survival instinct. it has to do with perpertrators not being jailed so that they cannot hurt multiple women and children. since it happens in south africa (which is where i live) too. and the perpertrators in most cases have previous records. whats going on is that laws help the perpertrators all over the world. and this line of thinking is archaic and needs to be changed since clearly its not working if one jailed perpertrators for lengthy periods they wouldnt be able to hurt all their victims and recreate the cycle of abuse. i mean in most cases these people have prior records and the victims many of them don't receive help i mean this guy fritzl was on the loose for 30 years who knows which other women he raped and killed??? If you go on westlaw or lexis and search jury verdicts, you can put in search terms like ';broken foot'; and get a list of verdict awards for people w/ broken feet and pick out the numbers that are different. Not sure how you would find them unless you are in that kind of data base or went to a law library where they had ';jury verdict reporters'; but you could try seeing if there are free 'jury verdict reporters'; on line or search your local paper archives for any verdicts that were publised.

    i don't think there are many cases like that, and i think you just have to find out when you need that specific -ing phrase. i don't really think there's a place that you can find all of them, you just find out.

    I agree with Dreamer, and would just add that, on average, indoor cats live up to several years longer than outdoor cats. There are a lot of environmental hazards outdoors, especially if you live in a city. Also, repeat vaccinations are a lot less necessary for cats that don't go outdoors.





    If you choose to keep your cat indoors, you've got to commit to monitoring your cat's weight and encouraging her to exercise and play.

    15-20 years. 20-30+ years if well cared for. For a cat to die younger than 15 is unusual unless they are poorly cared for. Quality food and fresh water are the best way to ensure health. As cats age, incorporate raw or canned food into their diet to prevent kidney/liver problems (dry food is hard to process, it requires a lot of moisture from the body, and as a cat ages, it becomes harder and harder on their organs to process dry food. Switching to at least a partial raw or canned diet gives them more moisture with their food and helps alleviate the problem. You can also soak dry food in water or chicken broth before feeding.)





    Also, lay off the vaccines, especially in older cats- after kitten shots, cats really don't need anything updated except rabies. Even if you do update when they're younger on things like distemper, once they hit around 10 years old, don't do it. Indoor cats just don't need the constant vaccines and it really wears down their immune systems after a while.





    Teeth are a big thing too- bad teeth cause infections in the gums that get into the bloodstream and cause organ failure and early death. Make sure you're keeping their teeth clean, again, especially as they age.





    Lastly, keep the weight off! Healthy cats actually look a tad thin to most people. Fat cats are prone to a huge number of life-shortening health conditions. It's actually healthier for a cat to be slightly underweight than slightly overweight. If your cat gains weight as it ages, cut back on the food or switch to low-fat.

    I would say a average age is 10-12. I have had several cats with my oldest living until he was 19. He died of kidney failure. My other cat was 17 she died of liver problems. I have 5 now ages 8,11,10,9,7. I feed them science diet. I feel that monitoring them for any problems and getting them to vets early on if they are sick plays a role in survival. :)
    Like people genetics plays a major role in your cats lifespan and its breed will also influence its longevity.





    Because your cat lives indoors I would say 12-15 years as an average.





    My cat recently went to the vet and her labs came out great! She is turning 11 and seems to be in better shape than my first cat @ 11.

    I have fed my many cats mostly store brand cat food and Purina cat chow. They mostly lived about 15-17 years, unless something unusual happened.     I just started studying Russian a couple months ago. I am moving along at a good clip and am wondering about the case system. I more-or-less understand the point of the cases and the role they play, but I'm wondering if I need to learn that right away, or if I should just focus on memorizing conversational situations for now.     Case systems can be very confusing when starting to learn a language, particularly when coming from a language where they are not used ('who' and 'whom' are some of the last remnants of a case system in English).





    I'd stick with learning some of the basics and maybe tackle one case at a time, until you're familiar with the declinations.

    Learn them a little at a time. When you learn an expression, figure out what the cases are and why they are the ones to use. I can't change the language but I can have an opinion about it; it just seems way more efficient to learn single prepositions (with single functions) rather than case endings, which change not only by function but also by gender, number and whether the word is a noun or an adjective!     Basically Aleksan (or what was his name?) is right. The cases are more important than the prepositions or the word order. Especially the prepositions depend on the cases they go with. For example, the preposition ';na'; can change its meaning depending on the case it goes with.


    I started to learn Russian as a foreign language about five years ago and didn't pay too much attention to the cases at first. Then after a year I realized that I was kind of lost without them. And it was really hard for me to learn them at that stage. So the sooner you start learning them the better. But don't try to learn too much at the same time. I'd start with the noun-cases at first and leave the adjective-cases aside. But in the end you will have to know all of them...

    I agree with Dreamer, and would just add that, on average, indoor cats live up to several years longer than outdoor cats. There are a lot of environmental hazards outdoors, especially if you live in a city. Also, repeat vaccinations are a lot less necessary for cats that don't go outdoors.





    If you choose to keep your cat indoors, you've got to commit to monitoring your cat's weight and encouraging her to exercise and play.

    15-20 years. 20-30+ years if well cared for. For a cat to die younger than 15 is unusual unless they are poorly cared for. Quality food and fresh water are the best way to ensure health. As cats age, incorporate raw or canned food into their diet to prevent kidney/liver problems (dry food is hard to process, it requires a lot of moisture from the body, and as a cat ages, it becomes harder and harder on their organs to process dry food. Switching to at least a partial raw or canned diet gives them more moisture with their food and helps alleviate the problem. You can also soak dry food in water or chicken broth before feeding.)





    Also, lay off the vaccines, especially in older cats- after kitten shots, cats really don't need anything updated except rabies. Even if you do update when they're younger on things like distemper, once they hit around 10 years old, don't do it. Indoor cats just don't need the constant vaccines and it really wears down their immune systems after a while.





    Teeth are a big thing too- bad teeth cause infections in the gums that get into the bloodstream and cause organ failure and early death. Make sure you're keeping their teeth clean, again, especially as they age.





    Lastly, keep the weight off! Healthy cats actually look a tad thin to most people. Fat cats are prone to a huge number of life-shortening health conditions. It's actually healthier for a cat to be slightly underweight than slightly overweight. If your cat gains weight as it ages, cut back on the food or switch to low-fat.

I have a water fountain to help encourage drinking (many housecats don't drink nearly enough water, which again, affects their kidneys).     I would say a average age is 10-12. I have had several cats with my oldest living until he was 19. He died of kidney failure. My other cat was 17 she died of liver problems. I have 5 now ages 8,11,10,9,7. I feed them science diet. I feel that monitoring them for any problems and getting them to vets early on if they are sick plays a role in survival. :)
    Like people genetics plays a major role in your cats lifespan and its breed will also influence its longevity.





    Because your cat lives indoors I would say 12-15 years as an average.





    My cat recently went to the vet and her labs came out great! She is turning 11 and seems to be in better shape than my first cat @ 11.

    I have fed my many cats mostly store brand cat food and Purina cat chow. They mostly lived about 15-17 years, unless something unusual happened. My oldest was a healthy 19 when she got mouth cancer. After 2 surgeries, it came back and we decided to stop fighting. Love your cat and it will love you.
