so when the state appoints it?who actually pays for the service the state or the complainant? So if im the complainant, can i get private lawyers and if so does it still mean the state appointed that lawyer as the prosecutor? In criminal cases?can prosecutor be from private counsel or the state just appoint them?
The state prosecutes crimes. You can hire a lawyer if you want, however the lawyer will not be able to participate in the prosecution of the case.
You could however hire a lawyer to file a civil action against the perpetrator of the crime to recover any damages you have suffered.

I got mine from Radio Shack about 2 months ago and it is of really good quality...I have already dropped it a couple of times. I don't know what brand my is because I had opened the package as soon as I got it and it does not have any words on it. It was about $16. Happy Holidays

In cases of rape how do they determine if the victim is lying or not?
if someone reports they've been raped....but they would be victimizer denies it saying it was consensual and or he never had sex with her period and there were no witnesses how can authorities find out what happend? In cases of rape how do they determine if the victim is lying or not?
After all the statements have been taken. They are sent to the DPP(The Department Of Public Prosecutions). They then look at the statements and evidence. They make a decision on what they have to see if it will go to court.
If it goes to court the victim has the DPP to represent them. The accused has there own solicitor. It is normally held in a closed court(this means no jury just a judge a police officer somebody who is taking the notes.the victim the a member of the DPP the accused there solicitor and anybody who has made statements.)
Then the Judge will decide on what will happen.
It's just one persons word against the the others.I was raped and in the middle of this process at the moment. And I realize a lot of people make false statements and I think that's disgusting. It makes it a lot harder on the real victims and the people who are prosacuting them.In cases of rape how do they determine if the victim is lying or not?
Best thing is to write down on a piece of paper before having sex that you both agree to have sex and date it and sign it!!! Ha ha ha. I'm afraid some day we'll go to this length. In the meanwhile if a woman looks injured when she gets examined by a doctor this is evidence of struggle. If there are no signs of struggle or injury and she is calm then who would believe her? In case of rape there must be struggle and it will be obvious if the victim is still alive. Also there can be DNA testing to identify the fluids in the victim's vagina. This can really incriminate the perpetrator.
On the issue of consent, yes we face the all too difficult position of he said she said. However as is often the case the victim is heavily intoxicated, in law they are unable to form the requisite capacity to consent and thus anything that the offender does to her is rape.
In so far as determining if something did in fact happen then we are forced to rely of forensic evidence and the medical examination of the victim. This is also fraught with issues in that the victim often feels that they're being raped again by the examining doctor.
Far too many rapes go unreported for a whole variety of reason.... shane, fear of retribution, shock, self loathing etc. Sadly far to many non rapes also get reported and this makes it difficult for police investigators to determine what is real and what is not. Police will balance the version provided by the complainant against the evidence to hand ... its all we have when working out the truth of the matter.
In my 10 years of experience I have investigated and assisted in the investigation of many rapes ..... far too many have in fact come down to what is politely described as 'post coital remorse' or ';what happens when my partner finds out?'; and the rape complaint is seen as the only way out.
I can say that all matters are treated as real and as rapes until proved otherwise and all are referred onto sexual assault services and counseling.
If anyone reading this is in the position of being the victim of an unreported rape, any police officer worthy of their badge will help you as best they can. A late complaint of rape is not always too late (a little more difficult granted, but not impossible)
Sadly enough, many people get off the hook if there is no solid evidence of rape. They may look at the reactions of the woman when being interviewed by police and lawyers and such, but there is no way of determining whether or not someone was raped with no evidence or witnesses.
If semen is present, it not only proves that sex happened, it can be DNA typed to match a specific person.
If a rape kit is ran, they can tell by the vaginal bruising (or anal bruising in some cases) if it is consensual sex or not...there is a ';sex clock'; standard...if bruising occurs at certain points on the ';clock'; is can show it was consensual or rape.
If no rape kit and after the fact, the perp will be tried via circumstantial evidence...if there are a multitude of other women that were taken advantage of, it could be proven and the perp convicted circumstantially.
The 'authorities' don't. In a trial, witnesses are presented and lawyers will attempt to sway the jury's opinions, but it is the jury that ultimately decides whether or not the victim is telling the truth.
Edit - However, this assumes that the matter even goes to trial. Sadly, these things often don't.
Credibility is a matter for the jury.

What is the meaning of ';about' in these cases?

Yes it's being used in the sense of approximately. It means it is almost the right thickness, length, and width in those circumstances. What is the meaning of ';about' in these cases?

Is the fact that only 6% of rape cases end in a conviction proof of a patriarchal society?
is the fact that only 6% of rape cases in the UK end in a conviction proof of a patriarchal (male dominated) society? Is the fact that only 6% of rape cases end in a conviction proof of a patriarchal society?
YES.
And in response to Lulabell's answer... how do you explain that in a case of a woman's word versus a man's, the man doesn't get convicted? Patriarchy. Is the fact that only 6% of rape cases end in a conviction proof of a patriarchal society?
That's ridiculous. It is the idea that everyone (women too) are innocent unless the evidence is beyond a REASONABLE doubt. You are being UNreasonable.
Phil is right. It isn't that he's believed, it's that you are innocent until proven guilty.
How would you like it if you were accused of a crime and you were jailed just off the other person's word? I didn't think you would like it. That's what this comes down to.
It is not evidence of it, however the whole world is a patriarchal society and always will be, rightly so.
i love how instead of people just ANSWERING THE FREAKING QUESTION, they go off on a speil about how the ';greater crime is all the false accusations';
yes, that's bad. but you know what? i'm having a hard time garnering any sympathy for anyone who, when confronted with a problem like a rapist walking free and raping again, just ignores THAT problem and shoves the lesser problem under the lens. disgraceful.
now, to answer your question, as a medical nurse i've seen it time and time again- she takes a shower. she cleans herself up. complete loss of evidence. no ability to prove anything.
and it's not her fault, either. i mean, heck, i'd want a hot freaking shower too.
so it all comes down to evidence.
No
Do we need any more proof?!
It isn't really proof of much at all. Basically what it means is that the majority of rape cases don't have enough evidence to prove guilt beyond any reasonable doubt. The judicial system in the UK is designed to favour the accused by requiring a very high standard of proof in order to result in a conviction. Rape is often a difficult thing to prove to that standard.
Of course this is terribly unjust, but what can really be done about it? You can't simply lower the standard of proof, since if a man is falsely accused of rape (and I don't believe that to be a particularly common scenario, but it does happen) then there would be a good chance of his being punished for a crime he didn't commit.
Until men stand up to men who rape men, women and children, and say rape is wrong and won't be tolerated under any circumstances, rape will continue. Look at how many people are justifying all rape because some are false accusations. So is all murder ok too, since some people are falsely accused of murder? Just why do so many of these people identify with the ones being accused of rape? It makes you wonder just what they are so worried about. Yep, the western world is still very patriarchal. A man's word still counts more than a woman's.
Rape is a hard thing to prove. Since you need proof beyond a reasonable doubt to convict someone of a crime, that's why there are so few convictions.
Dream Fairy- Got a problem with men? I've heard of a woman do every single thing you stated except school shootings. They're not as common, but they happen. Actually, women do abuse kids more often.
Lindie- Yeah we all know a woman's word is more important than a man's and all men should be jailed instantly at the word of a woman.
Some women won't rest on this until we jail every single man accused of rape apparently.
Qwerty has issues too.
I'd be curious to know the difference between the conviction rates for male/female victims. Seems like when there's a male victim, the entire world pays attention and the court system is inclined to pursue all avenues that ';justice is done';
Does the 6% number include male victims, not include male victims? Either way, the differences could be huge.
Knowing this number would certainly contribute to the question of a patriarchal society.
I know for a fact its very hard to prove rape. Part of it is to protect the attacker from false accusations. I'm divided on the issue. There are many cases where the attacker walks away without so much as a slap on the wrist. I know of one such case personally. But, at the same time, we shouldn't make it so easy to convict a person based on accusation that innocent people are sent to jail.
Proving most rapes is often very hard because it comes down to ';he said-she said';. Personally, I don't see how they can change the standards without risking innocent people. While I agree that the percentage of false accusations are not near as high as some of the people on the forum will try to make it, we have to be aware that, yes, there are some people out there who will make false accusations.
Unfortunately, its just a situation that seems to have no remedy.
Some things that have helped, however, is that when on trail they can not bring up your attire during the attack or your past history. Small steps like this is at least helping women gain the courage to come forward after an attack. This way they don't feel like they'll be attacked again while on the stand (which, of course, happens anyway).
I don't know why men think and speak highly of their gender, they are the rapists, murderers, theives, bombers, home-wreckers, unfaithfuls, abusers, even the students who have gone in shootings are all males! God's gift to women? yeah right.
Oh and to answer your question, they may get away with the law of men but the Law of God they will never escape.
Edit: in regards to those questioning whether the case was reported; I know of 3 people who reported their case to the court and let me tell ya, they lost okay? All 3 of them. One of them, molested by a relative when she was only a child testified in court as a teenager and she LOST THE CASE okay? do you get that? The judge did say she believed the child but there was not enough evidence... she was a child.
Querty: ';And I am glad your friend lost. That'll teach her to falsely accuse others of rape!';
You can say this because you know this case inside out right? These hateful comments you spew just makes you a great example of the type of males I speak of.
As for your child abuser comment, maybe the reason for that is due to the fact that the baby daddy just bails, where is the daddy to protect the kiddies?
What is comes down to is a weight measure.. The judges and juries on one hand measure the value of the victim/survivor, a mere woman, and her future value to society, against her perceived damage. The life-long damage that rape causes to the woman, her future spouse(s), and her children is severely under-valued. Even in this forum, men have acknowledged that they think that rape is no more than an unwanted sexual experience and do not even understand the extreme physical pain involved, much less the unending, and unmendable emotional scars.
Against that side, they measure the accused, and man, who is perceived to be far more valuable to society for the contributions that he may make in the future, and weighed against that are the damages that he will endure if convicted, meaning a certain amount of years in jail, and the loss of what he would have contributed to society if he was free.
WIth that in mind, you will only have a conviction if the woman is from a good family, and educated, having a future of great contribution to society, and if the male is of low-breeding, and has little or no education, and is not expeced to contribute much to society. That accounts for the low conviction rate.
The idea that it has anything to do with the testimony at trial, or the guilt or innocence of the accused is a myth. The same thing is true for murder. It is not about guilt or innocence, but about who you murder, and who is accused of murder. If the accused is brought to trial for murdering someone more valuable to society that he/she is, they will probably be found guilty. This helps explain the large percentage of minorities in prison.
This is based on many jurisprudence studies done in the US, but I suspect that the same thing holds true for the UK, since both societies are very class conscious.
I'm not so sure that it is patriarchy that dictates this statistic. Rape cases are generally hard to prove if there is no physical evidence such as spermal (is that a word? LOL) DNA. But I would say that it is still widely believed that a rape victim has somehow done something to deserve what happened.
possibly, but perhaps it also has to do with how many women actually report the rape, because many do not. There is still some way to go in changing attitudes to this heinous crime and as to qwerty who said they are all liars is obviously having a bad day. Also remember that women also serve in the judiciary so its not always men that are at fault.
On one other level if men that do this and who are caught after the first time and are let out and do it again i suggest a mandatory 30 year prison sentence. No argument.
Yes I think it's one piece of evidence that the UK, like other Western countries, continues to maintain patriarchal institutions and attitudes.
(Got some figures and the link below) Bloody disgraceful.
Only about 12,000 are recorded by police (see figures below).
There were 820 convictions recorded for rape in 2005/6, up from 618 in 1997.
It means only 5.7% of reported rapes end in a conviction.
and
The majority of perpetrators are known to the victim
97% of callers to Rape Crisis Lines knew their assailant prior to the assault
During 2001 it is estimated there were 190,000 incidents of serious sexual assault and 47,000 female victims of rape/attempted rape
Home Office figures show that police recorded 12,630 female rapes in 2006-7
Data from Children and Women Abuse Studies Unit and Home Office
Edit: For the numbskulls touting the absurd (and unprovable) lie that 50% of complaints about rape are probably false, even if that were true, it would mean that instead of 47,000 victims of rape, there'd be 23, 000 victims. Of the 23,000 victims, 6,000 would have police record a complaint. Of that 6,000, fewer than 1,000 would be prosecuted.
That. is. still. unacceptable. You. have. no. right. to. expect. women. to. put. up. with. this.
Instead of being apoloogists for rapists why not be real men and actively condemn rape and the rapists amongst you.
';A third of suspects whose victims were under 18 were not investigated, but had histories of violent offending. Among those cases that were crimed, but didn't get past the police investigation stage, were some with known histories of offending who were not prosecuted, ';in the public interest';.';
(link below)
- and to people saying these are feminist figures they're not - they're data collected by the Home Office and official police records - but you know, thumbs down by all means - gotta do whatever you can to protect that rape mentality.
Creeps. I'm so angry at the appalling stupidity and lack of concern that I see on this board that I could barf.
(See link below - there is evidence in over 80% of cases).
Edit: and for people who follow Farrel like uncritical, mindless sheep; he has no credibility, is a supporter of incest and child molestation and as such is no authority whatsoever re: any sort of rape or molestation issue. (link on him and his demented ramblings - xyonline - is below).
yes.
all a man has to do to ';prove'; he didn't rape a woman is say ';yeah, I had sex with her'; and he walks. the evidence of sperm is useless, hey of course there would be sperm, he said he had sex with her. Bruises fade and could have come from anywhere. (although I think I'd remember getting whacked hard enough in the thigh to cause a bruise) in he said she said, hell, it's always her that's lying.
In Canada the victim serves as evidence. Nobody represents her and to actually go through with a trial is revictimizing her and forcing her to relive the trauma again and again. There is very little chance of any type of restitution fo the suffering, lost wages, lost life and oftentimes post traumatic stress syndrome.
Many men live in a fantasy land of self deception as individuals. Most pretend. And they insist that the women around them pretend, that they are the white knights and that the sexist men are characters they have seen in bars or heard at construction sites but certainly are not like themselves. Some openly attack feminists by claiming that they too have counted the wounded and named the attackers and that we feeble minded women have simply failed to see reality. They are here to assure us that with sober second thought we will see that all is well with the world and that we need only draw and quarter those five bad guys.
Not necessarily!! It could be proof that the woman was lying or that the woman did give the man some hint that it was ok to do it. I think that it's discriminatory to assume that it is ';proof';.
';A patriarchal society';?
All societies are patriarchal.
What exactly do you compare this too?
A patriarchal society gave us courts that allow us to even try these accused rapists. Also, we don't put people in prison unless a crime can be proven. Simply accusing someone of rape is not enough to lock them up.
Realy??...is that true??... that's a shame.
But to confirm if is a sexism problem u have to know first of all, what are the causes of the low rate on condems... maybe is a corruption problem.
I think its proof that individuals and society in general have a very vague and subjective understanding of what constitutes ';rape';
Edit- I completely agree dream fairy, why would they need something like evidence to convict some one of a crime?
lol - ofcourse not.
Its simply due to the fact that most rape cases come down to the womens word against the man.
They can't convict someone if there is a shadow of a doubt that they might be innocent.
Its not enough to prove they had sex, they have to prove that she said no and that he forced himself onto her.
Unless they had a tape recorder playing - how do you suggest they prove that?
Wow - that ain't good.
I didn't prosecute due to the humiliation factor. I didn't want to rehash the gory details in open court, or be cross-examined to the point where I'm feeling worse about what happened and blaming myself.
Pretty sad...
Found this for your reading pleasure...

I'd think it was more likely that only 6% prove beyond a reasonable doubt that a rape occurred and the suspect perpetuated it.
Considering how many false claims of rape are filed each year, it is amazing that there are any convictions at all.
What *IS* a patriarchal society? In my 60+ years, I can't find it and have never seen it. Is this another of the myths like the ';wage-gap';? Am I supposed to benefit from being male? I haven't, in fact, it's been a detriment in many cases like divorces, custody, jobs and promotions.
No, the fact that there is such a crime as rape disproves your assertion. If you add to that, the fact that most of the acts these days coming under the definition of rape, aren't what most rational people would regard as worthy of the name. Then we have false allegations. Figures show, that if you reduce the crime stats. to include only those acts which used to be regarded as rape, false allegations, and those claims where there doesn't seem to be a case to answer, they haven't risen at all.
Let me fire one back. There has always been considerably more male prisoners than female prisoners. How can men, therefore, have framed the law to suit their own purposes? It is clear that men have a much harder time than women in staying inside the laws of the land, as you would have it, framed by men themselves.
You have to remember, if you are a reasonable person that is, that men have a much stronger sex drive than women and have been primed by nature to be the chasers. So, don't expect to stop it once intercourse has commenced, because the right time to do this is before.
That depends; Is the fact that at least 50% of all rape complaints are *provably* false evidence that women are huge liars ?
The law and courts are supposed to convict when there is sufficient evidence of a crime having been committed in the first place, and evidence that one particular person committed it.
Theres an old saying about Justice: It is better that ten guilty people go free than one innocent person goes to jail.
Warren Farrell, in his book The Myth of Male Power (1993, p.322), cites an Air Force study that investigated 556 charges of rape by servicewomen. In that investigation, 27% ADMITTED that their accusations had been false either before or after being confronted with lie detector tests.
Farrell cites ';False Allegations,'; Forensic Science Digest, V. 11, no. 4, Dec. 1985, p. 64, by Charles P. McDowell. Farrell says the Digest is a publication of the Air Force Office of Special Investigations in D.C.
Also, Kanin, E.J., (1994) ';False Rape Accusations';, Archives of Sexual Behavior, V23, P81-92, Kanin finds that 41% of reported rapes were outright fabrications, by admission of the woman.
Note that in both studies, you get high numbers just from recantations by the women, it is logical to presume that not all the false claimants recanted, so the percentage of false claims MUST be higher than the 27% and 41% figures.
Note, as well, that the law rarely sanctions false claimants, thus making further false claims all the more likely.
See also the Duke Lacrosse team rape case, which did a LOT of damage to innocent men, yet resulted in only one day in jail for the rogue prosecutor, and none for the false claimant. Let us know when the conviction rate of false claimants comes UP to 6%...
No, we live in a patriarchal society but that statistic doesn't prove anything.
Sources, because is this 6% of all reported rape to the police, or just an estimate to include the unreported cases.
That is my problem with feminism, using fake, false or misleading stats to back up an agruement.
I'm very skeptical of any stats relating to female victim-hood in the west.
I'd hope the figure is a lot higher than 6%.
Anyway, if there really was a patricarchal conspiricy to rape women we would just build big factorys to house automated rape production lines instead of making the washing machines and other appliences that make your life easier.
False allegations of rape by women against men is an even bigger problem.

It is not evidence of it, however the whole world is a patriarchal society and always will be, rightly so.
i love how instead of people just ANSWERING THE FREAKING QUESTION, they go off on a speil about how the ';greater crime is all the false accusations';
yes, that's bad. but you know what? i'm having a hard time garnering any sympathy for anyone who, when confronted with a problem like a rapist walking free and raping again, just ignores THAT problem and shoves the lesser problem under the lens. disgraceful.
now, to answer your question, as a medical nurse i've seen it time and time again- she takes a shower. she cleans herself up. complete loss of evidence. no ability to prove anything.
and it's not her fault, either. i mean, heck, i'd want a hot freaking shower too.
so it all comes down to evidence.
No
Do we need any more proof?!
I'd be curious to know the difference between the conviction rates for male/female victims. Seems like when there's a male victim, the entire world pays attention and the court system is inclined to pursue all avenues that ';justice is done';
Querty: ';And I am glad your friend lost. That'll teach her to falsely accuse others of rape!';
';A third of suspects whose victims were under 18 were not investigated, but had histories of violent offending. Among those cases that were crimed, but didn't get past the police investigation stage, were some with known histories of offending who were not prosecuted, ';in the public interest';.';
I think its proof that individuals and society in general have a very vague and subjective understanding of what constitutes ';rape';
Found this for your reading pleasure...
http://www.d.umn.edu/cla/faculty/jhamlin鈥?/a>
I'd think it was more likely that only 6% prove beyond a reasonable doubt that a rape occurred and the suspect perpetuated it.

Where to find a federal lawyer that takes cases (prison system) against the Bureau of Prison?
my fiance's friend was in federal prison. while there he was diagnosed with cancer. he was there for 10 yrs and he didn't get cancer til he was there 8 of those years. he must have got it while he was there. he got head and neck cancer and feels he got it from the prison system cause 85% of the people that have it smoke and he's never smoked. i needed help to find the type of federal lawyer in the USA that covers those kind of cases? he's looking for federal lawyers that take cases against the bureau of prisons. Where to find a federal lawyer that takes cases (prison system) against the Bureau of Prison?
There are no ';federal lawyers.'; Lawyers get licensed to practice before a particular federal court. Look for the website for the state bar association where the prison is. Find one that is licensed to practice in the US District Court for the area where the prison is located.

Is the police allowed to publicise cases?
is any police force allowed to publicise cases as it pleases? or is there some sort of permission needed from those involved with the case to allow the issue to go public? Is the police allowed to publicise cases?
The police have fewer restrictions on them than the prosecutor's office does. The prosecutor's office is obligated to restrict information given to the media to protect the defendant's right to a fair trial. The police departments usually go along with that, at least to some extent.
But basic identifying information about the people involved in the case is usually part of the information that is properly released. Child victims are usually not identified by name. Adult victims of sex crimes can be identified by name, but most newspapers don't publish that. Information concerning juvenile offenders is usually not publicized unless the child is to be tried as an adult.
Also, the media often get information that is provided at public court hearings, such as bail hearings, where the State will often lay out its evidence for the purpose of getting a high bail.
But people involved in the case don't have a unilateral right to restrict what information is released or published. Is the police allowed to publicise cases?
Every single case is available to the public under the first ammendment. Juvenile cases can NEVER be publicised due to the laws of juvenile privacy. Also, if the case is a concern of National Security, The CIA, FBI, or HomeLand Security agencies can decide wether a case be publicied or not. However if you are over 18, and you say, robbed a house, anyone can view your case.
It is not within the authority of the police to keep a case public or private. Most prosecutions are public record. Sometimes the victims' names are not disclosed, but the offender's name is public unless it will cause the revelation of the names victims of incest or other sensitive issues.
As long as you are over 18 they can use your name in the newspapers if you commit a crime. If you're under 18 they usually don't release your name in the crimelogs
Only when it is in their best interest.
-no different than any other entity, they only want you to hear the nice things they are doing.

As more sick illegal aliens come to the US will the number of flu cases in the US increase?
Does controlling the border matter? As more sick illegal aliens come to the US will the number of flu cases in the US increase?
The flu cases in the US will increase regardless of the state of the border. As more sick illegal aliens come to the US will the number of flu cases in the US increase?
You are apparently discounting the cases due to Americans having visited infected areas in your obvious attempt to criticize illegal aliens. Controlling the border is a different issue from closing the border and preventing travel, whether by US citizens, legal aliens or others. This flu has spread to several countries so that would be an ineffective solution.
no not really since the virus is just like the flu and it doesnt really kill u necessarily unless ur immune system is weak...but yea the people who are coming into the country arent really illegals there just ppl who were out of the country and are citizens that are returning...where some of them may be already sick and carrying the infection that is spread airborne and yea ...
Someone has been listening to too much hate radio. Now all current immigrants are stigmatized by the swine flu label. It saddens me to see that people justify their hatred with misinformation and purport themselves to be authorities on ';logic.'; They have neither logic nor compassion.
Now the reports say the H1N1 flu may have actually started in California ! Hong Kong now has it. Right wing hate radio still blames Mexicans. Do you ever wash your hands? Try it, it'll help a lot to prevent the spread.
No. The virus is already here and the disruption caused by closing the border will not be worth any benefits (of which there will be none).
The flu has already mostly run its course in Mexico anyway.
The border doesn't matter now. The virus is here. Closing the border will make no difference at this point.
As American Citizens return from their Mexican vacations, they will/are spread it.
No. It's the flu! Get over it,I did!

Where exactly are the SWINE FLU cases in San Diego?
Where exactly are the ';8'; swine flu cases in San Diego? They're are apparently 7 suspected cases, with 3 new cases just reported this morning. Anyone have a clue? North/West/East/South?Where exactly are the SWINE FLU cases in San Diego?
I have no idea. I live in San Diego and I'm more than a little concerned about this disease...Where exactly are the SWINE FLU cases in San Diego?
I'm sure if you contact the CA State Health Deparment they could tell you.
I found this info at the website below:
School officials in Contra Costa County moved fast once they realized early Tuesday they had a group of sick students with symptoms that matched swine flu.
By noon, Highlands Elementary School in Pittsburg had contacted the district superintendent, who sent the students to county health officials for testing. Three of the fourth-graders were found to have probable cases. Officials decided to close the school for a week, activating an e-mail blast and phone tree that notified parents of 645 students of the closure.
County officials also were investigating a cluster of sick students at nearby Marina Vista Elementary School, but there were no immediate plans to cancel classes.
A handful of other schools have taken similar precautions after local officials found that students there tested positive for swine flu.
San Jose's Branham High School will be closed for a week because a 16-year-old girl was suspected of having swine flu, and Mountain View Elementary School in Visalia planned to shutter for three days after two kindergartners fell ill. Earlier this week, two private schools鈥擟hrist the Cornerstone in San Diego and St. Mel School in Fair Oaks鈥攁nnounced similar closures.
Two Southern California universities issued warnings to students and faculty after each found a student with probable cases of the virus.
A student living in a California State University, Long Beach, dormitory came down with symptoms Sunday, prompting local officials to request a stockpile of anti-flu drugs. San Diego State University officials said a female student who lives off campus was receiving treatment.
The Pentagon said Wednesday that a Marine who fell ill at Twentynine Palms had the first confirmed case of swine flu to show up in America's armed forces. The unidentified patient first complained of being sick on Saturday and is doing well.
i'm not sure about the other cases, but there is another probable case in san marcos. this kid goes to my school and it was just shut down for 2 weeks. they're really being very cautious with this and want to make sure none of the others students were exposed to it. there are 3 high schools closed down in north county so far. just look on news websites to find out more.

Last October, an uninsured motorist hit me head on, putting me in a wheel chair for four months and causing me permanent physical damage. I feel like I hired a crappy lawyer who is trying to settle for an amount that won't even cover my future medical bills. He keeps insisting that, because I live in a conservative state, taking this case to trial could result in myself getting even less.
Is there any way to find records of previous car wreck cases that have gone to trail and, more importantly, how much they settled for?
I live in Tennessee.Where Can I Find Previous Similar Cases?
Try http://www.findlaw.com/ you can research case law as well as get an opinion from a lawyer and seek out a lawyer.Where Can I Find Previous Similar Cases?
You lawyer makes sense. My wife was in an accident where she was hit by a young girl talking on her cell phone. the girl blew the red light 45 seconds after it turned red. We walked away from it with my wifes medical bills paid and only $21,000 after the lawer got his share. It is very tough to sue for future medical bills unless if you prove you have perminent damage that will require future surgeries that cannot be done before the settlent due to specific medical reasons.
Example: You cannot say I might get arthritis and require another surgery 15 years from now. Might and maybe do not stand up in court..acne treatment

For a successful relationship, in most cases do a man and woman have to share the same views/interests?
For example, religious or political philosophies, hobbies or professions. For a successful relationship, in most cases do a man and woman have to share the same views/interests?
No!!
People are sometimes opposite of there soul mate. For a successful relationship, in most cases do a man and woman have to share the same views/interests?
For me, I think it's VERY important to share religious views. I love my God and my Lord, so it only makes sense to stay with someone who also share the same passion. I also think it's important to share similar core values, for example on how to raise our kids and how to save/spend money and share similar views on future goals/ambitions and such as well. And yes I also think it's nice to have same political philosophies, but this doesn't matter as much ya know?
I could care less if he has different hobbies or professions, it's all about compromising and learning to accept our differences.
Not necessarily, but it can be difficult if you do not. The pros of having different hobbies and professions is that there is actually more to talk about at the end of the day.
Initially I had a hard time coming to terms with my husbands political philosophies and the fact that he was not religious, but we got over that.
Yes, definitely. A successful relationship is about a balance between doing those things you love together, and doing things with others (family, friends). But it is also very important that one or the other does not feel he/she has to be doing things with their spouse all the time.
I enjoy spending time with my husband, doing ';our'; things together, and when I think about ';what if';, meaning, what if we didn't have those common things to hold us together, I wonder what we'd be doing with each other. I truly enjoy the things we do and I love doing those things with him because we both share that same passion. The reason you are attracted to a person might be one thing, but the things that hold the relationship together involve just being a couple! And doing those shared-interest things a couple should do.
That said, it is equally important that each person does not feel suffocated or that they have to spend this day, and that time with their spouse, or at least that's the case for me. I love to be with friends and there are things we do together my spouse wouldn't even consider.
So basically, yes the need to have the same interests. Views, well that helps too.
Not really: I have diplomas from three Universities, I read at least two books a week. I read two newspapers and the 'Net, I keep up with the news.
My wife has never read a book, she only looks at a newspapers sale section. She's a high school graduate though.
She has absolutely no interest in anything outside the home. She doesn't like to cook, I do most of it. She doesn't know we just got a new dryer, I do all the wash. I share the dishes and cleaning with her. As long as A%26amp;E is on, she's quiet and, she's no longer interested in sex. By the way, we've been married for over fifty- two years.
Mine and my husband's relationship is not successful and we have none of the same views or interests. (I could never have anything in common with such a loser.)
i think its good to have SOME of the same morals, values and hobbies but everything doesnt have to be the same for the relationship to be successful...by being different you can teach eachother
In a way yes or you both have to agree to disagree on certain things. Its better for the relationship if you have the same views and interests, makes living together much easier.
Not at all, but each partner must agree to disagree respectfully.
Sharing the same views and interests, etc would be mind-bendingly boring. Intellectual stimulation is so important in any relationship.
Yes on religious/political philosophies because they indicate your stance on moral issues. Hobbies and such...not as much, but in some cases...yes.
Yes, and the woman is supposed to bend to the man's wishes as long as they aren't sinful.
No!!

There is now 8 confirmed swine flu cases in my city, 6 in the past 2 weeks and I am 9 months pregnant?
Should I stay home? I was thinking about going to the mall and to a festival but am second thinking this after watching the news. Im scared because Im pregnant and it seems to kill pregnant women because our immunity is down. What should I do? Also my daughter who is 2 has been coughing a bit and I just assume it's a cold but now Im scared she may have picked something up...we are out and about in public places A LOT. Advise please. There is now 8 confirmed swine flu cases in my city, 6 in the past 2 weeks and I am 9 months pregnant?

I actually agree with the first two people and believe me, I don't panic when things like this go around. My 24 year old daughter is also pregnant (only 5 months right now though) and I worry about her too. Your immune system is lower when you're pregnant and it's just not worth the risk. Also, call your child's doctor on Monday to see if they feel you should bring her in just in case too.
Good luck and Congratulations on the New Baby! :)

Can a divorce in case of temporary green card through marriage leave to deporation? If Yes In what cases?
I have been married to a US Citizen for more than an year. I have been exteremly nice to her but she always creates problmes and is now threatening me that i can be deported for some extermely minor things. If a divoce takes place in this case, what are the chances of deportation? Please help. I have a good record here in US.Can a divorce in case of temporary green card through marriage leave to deporation? If Yes In what cases?
It will come down to whether or not it can be proven that the marriage was just one of convenience to obtain a green card vs your actually having fallen in love with the person and marrying her.
You can't be deported for a speeding ticket or failing to pay a bill for example but what are the minor things/
In any event contact an immigration attorney ASAP to see if they can have the conditional green card status removed to a permanent oneCan a divorce in case of temporary green card through marriage leave to deporation? If Yes In what cases?
EVERY TIME SHE THREATENS YOU, INFORM THE POLICE SO YOU HAVE A RECORD TO PRODUCE TO THE INS AND PETITION AS A SPOUSE OF AN ABUSIVE CITIZEN. BECAUSE AFTER YOUR DIVORCE, THEY MIGHT REVOKE YOUR LEGAL STATUS AND PROCEED WITH A DEPORTATION ORDER ON YOU. THEY'LL NORMALLY SEND YOU A LETTER ASKING YOU FOR REASONS WHY THEY SHOULD LET YOU STAY AND THAT SHOULD BE YOUR EVIDENCE.

The earth submits to gravity, in many cases submission is natural - why do women resist the idea of submission
sometimes submission is appropriate but some women (mostly feminists) are so crazy in this subject, that they will not even look at 'submission' in any other context than that of being a ';victim'; or being ';inappropriately dominated'; by a man.
Your thoughts? The earth submits to gravity, in many cases submission is natural - why do women resist the idea of submission
After releasing myself in full submission I realized I allowed my tender heart to be placed in the hands of an unworthy man. And to recover what I lost inside myself still seems an unbearable defeat to accept. So to submitt now seems like a blind leap over a cliff of which has no ground. oooo you got me talking like a weirdo, cool....The earth submits to gravity, in many cases submission is natural - why do women resist the idea of submission
Because they have belief in their point of view.
Gravity is not just a good idea. It鈥檚 the law.
You really can't think of anything else can you?
Bodies do not ';submit'; to gravity. (Nor does rotation cause gravity) Gravity is the curvature of the space-time manifold caused by the presence of other bodies which creates perturbations in the otherwise straight world-lines of bodies traveling near those curvatures..
And your argument is idiotic.
It should be further noted that gravity effects all bodies, i.e. the Moon's movement is effected by the Earth's mass but the Earth's movement is also effected by the Moon's mass. Likewise for Earth and Sun. And for the smallest particle of matter.
So if you want an analogy, think about symmetry and reciprocity as the lesson of physics!
The earth doesn't ';submit';; the rotation of the planet causes gravity.
Then let's ask this question back: why don't men submit to the will of women?
Submission is not slavery.
Someone has to be the head of the household, and it falls to the man...males are generally better leaders.
That's not to say that the man shouldn't ask his wife what she thinks. That's only courtesy...men are supposed to LOVE their wives.
The husband is the captain and the wife is the first officer, the way I see it.
The answer is obvious. Submission is a two-way street. If it is so natural, why then do MEN resist the idea of submission?
why is it that the woman submits...should not this also apply to men...so that they are the submissive ones...
WHAT DOES ';SUBMISSION'; MEAN.
All you guys go on and on about this and no one has explained it. Does it mean I should sit around and clutch my pearls and vote Conservative and move out when gay neighbours move in next door and have a pine kitchen table and darn my hypothetical husband's trousers and never speak and cook dinner when he tells me to and smile when he calls me a ';*****'; or a ';wh0re'; and never go out and wear clothes from Cotton Ginny and get really fat and drive an SUV and listen to adult contemporary music and dye my hair from a box?
Submission is never appropriate. Partnership sometimes means letting one person or the other take the lead. However, a partnership never involves submission. Women are looking for partners, not domination. Some guys won't accept that women are as smart, strong, and capable as they are. Men realize that women are meant to be people, not possessions.
Because most women beleive we can think for ourselves and make our own decisions. I WILL NEVER. EVER, ENTERTAIN ANY NOTION OF SUBMISSION.
If another woman chooses that for herself - fine but the idea of feminism is equality and choice.
Man is not gravity
and Women are not planets
If you like the idea of submission, YOU do it, and let the rest of us lead our lives as we see fit.
ADULTS don't submit to anyone.
';Symmetry and reciprocity';....Love it!
Submission is taught in Muslim countries, and maybe in the deep south in the U.S. But it's just another name for slavery.
clever analogy.

When is the supreme court in session and what are the two most current cases that they are over looking?
when is the supreme court in session? what are the two most current cases that they are over looking? what does it take to have your case brought infront of the supreme court? When is the supreme court in session and what are the two most current cases that they are over looking?
The Supreme Court follows the Jewish calendar, so its term year begins in October. Since the Jewish year generally ends in September, the court starts its new term in October. This became so confusing that now the court clerk tells petitioners to leave the ';term year'; off of the cover of the petition (because people did not realize the court's term year follows the Jewish calendar).
This is how it works. When the court starts its new term (after the Jewish year ends), it counts whatever year we are in as its new term year. So right now, the court is in its ';October Term 2007'; even though it is already 2008!When is the supreme court in session and what are the two most current cases that they are over looking?

I can't understand why a trial needs to occur in any DEFINITELY guilty cases? Like Josef Fritzl?
Fair or not, we KNOW some people are guilty and that means they shouldn't have any defense. I don't understand why truth is not important in some cases but it's rather how well evidence is presented. It's not a freaken game!I can't understand why a trial needs to occur in any DEFINITELY guilty cases? Like Josef Fritzl?
He could avoid a trial by pleading guilty of all charges. Then it would be up to a judge to impose his sentence.
But that sort of thing usually comes from some kind of plea bargaining for a reduced sentence, and no prosecutor is going to want that. A trial would guarantee that once done, he is going to get the maximum penalty allowed for his terrible crimes.I can't understand why a trial needs to occur in any DEFINITELY guilty cases? Like Josef Fritzl?
We need to uncover the truth about what happened.Knowing that he is guilty is not enough. We need to see the evidence so that we can see exactly what he has done, even though the defense may try and twist the facts to get him off - that's their job.
The other side of the coin is that sometimes we 'know' someone is guilty because they fit the profile, and are not a very nice person anyway and may even have done similar crimes, but in a particular case might be innocent. If we just convict without trial there would be many more miscarriages of justice than there are with the jury system. Also who are we going to appoint to decide? The present system is flawed, but it's probably the best of a bad lot. There's no perfect solution, I'm afraid.
he may be definetley guilty, but that's not really the point. It is up to the judge and a jury to make that decision, after hearing all the evidence, and assessing WHY this took place. Only this way can justice be served. After all, given what we know, he'd just get time for rape and imprisonment...more could come out in a trial, extending his sentance, or causing him to be booked in for mental treatment... We base our judgements on the media, whish isn't really an unbiased view, is it. No it's not a game, but this is how justice works in a democracy...innocent until proven guilty...
Didn't you know that we are supposed to be modern upstanding people?
We couldn't go back to the bad old days!
We are an advanced people with morals and ideals.
This is our world.
Justice is in the mind of the beholder.
We can only do what can't be seen.
Ask your president what that means.
Can you base your judgement of his guilt on media stories?
From what I have seen or read he seems to be guilty of rape and imprisonment but I'm not a judge or on a potential jury.
If YOU were accused of something wouldn't YOU want a chance to defend yourself?
I say that you are his accomplice.
If enough people agree with me, you'll SCREAM for a fair trial.
If he's guilty, IF. . .then he'll get convicted.
If he isn't convicted, you should go to jail for inciting to riot.
In this case wouldn't it be nice to lock him in that dungeon %26amp; throw down food until he dies? But it would make us as bad as him. I guess the same could be said for having a fair trial.
as i've said before to a whole lot of these posts the hype needs to be directed in the right direction. firstly what i want to know is why time and time again are authorities giving perpertrators rights over victims. This man raped a women before his daughter, was only given 18 months for it, got to adopt kids the same gender as the women he raped which i think is really sick, has his criminal record removed after only five years, since his daughter ran away twice b4 the dungeon episode was returned to her family by the police ( if his criminal record had been available) maybe this wouldnt have happened. and is allowed to build a dungeon like cellar if a rapist told me he wanted to build a sound proof room underground i certainly wouldn't think his intentions were good. didn't have his privacy invaded. since clearly rapists have a right to privacy too must be what the austrian authorities think. yeah right privacy to hurt and torture people. sadly this is another case of authorities being to lenient with people. i mean if one was austrian and raped somone at 20 the most one would get is 15 years (yes its completely shocking that the maximum sentence in austria is 15 years for sex crimes) this person would be out at 35 at most by which time they would have learnt that the next time they must do it so that they do not get caught. i think people all over the world should start protesting about these ';enabling laws'; that enable perpertrators of these crimes to get away with their deeds until they do something really horrific. i mean its happening everywhere all over the world time and time again you here some peadophile has done something really awful killed, raped or tortured children and then you hear but wait this guy had a previous conviction for a similar crime before he did this terrible thing and was given a light slap on the wrist the first time. if any good is to come out of this the authorities and law makers of the world will start waking up and realising if they jail these people the first time for lengthy periods in order for justice to the original victims as well as preventing future victims. why are laws being made for pedophiles. i mean its like the average pedophile gets to hurt at least two or three kids before he actually gets a tough sentence. and as for the daughter she was raped from the age of 11, ran away twice and was returned home to her parents by the police, was drugged, made to give birth without any medical care or attention. the poor women was probably mentally and physically exhausted, that she managed to last that long without dying is a tribute to her survival instinct. it has to do with perpertrators not being jailed so that they cannot hurt multiple women and children. since it happens in south africa (which is where i live) too. and the perpertrators in most cases have previous records. whats going on is that laws help the perpertrators all over the world. and this line of thinking is archaic and needs to be changed since clearly its not working if one jailed perpertrators for lengthy periods they wouldnt be able to hurt all their victims and recreate the cycle of abuse. i mean in most cases these people have prior records and the victims many of them don't receive help i mean this guy fritzl was on the loose for 30 years who knows which other women he raped and killed??? besides going to thailand where he probably abused kids and women there as well and those people will never receive help for it. i really think a petition should be started in order to demand perpertrators be jailed for long times. its like a war against women and chilldren the UN should get involved instead of milling around worrying abt issues that are not as important and an international law should be passed that states that pedophiles be jailed for 50 years mininum for the 1st offence. thats what would be the best tribute to elisabeth changing laws that would help prevent anybody else from going through the trauma she did. i'm sure if one asked her now what she would have wanted, would have been the police not returning her to a rapist, her dad's criminal record to have been known regular visits from social workers while she was still young letting the kids know abt thier dads previous conviction and looking at the kids welfare just to check if he wasn't doing the same thing again. also maybe she would have wanted this record clearing thing to be removed since if it had been known when she was reported as a missing person interpol would have had access to it and questioned her father and maybe inspected their home and seen the cellar. what the austrian authorities did and many authorities all over the world was in effect inhibiting the progress of the case by removing the record. time and time again the authorities could have saved her if laws hadn't been in place protecting the father. i have to agree with the above person in south africa babies are raped, a nine month old kid, every thiry seconds a women is raped as i said before this is the official statistic, this one guy who was in court recently raped 100 women. this one guy hacked a kids head off and he had prior convictions for chopping a girl's finger off. The heinous crime is the laws which enable these people to be out on the streets and protected from people finding out and exposing their innocent children, who are defenseless to these kinds of people. so i think that people should start waking up i mean go research a lot of these cases and in most of them the first time the guy was caught for something he was given an easy ride. i think that the laws need to be changed to start protecting people who are victims and not pedophiles instead of the other way around. i think the reason the authorities don't want to tell the world rosmarie knew or investigate the possibility is that they are concerned abt elisabeth's mental health. i mean while she is still recovering imagine the mental shock and blow to her it would be if they confirm her mother knew that would be like absolute betrayal and possibly put her into a guilt mode since most child abuse victims feel and are encouraged by the abuser to feel that it is their fault. so i think they want her to recover a little bit even if she relies on the witch of her mother to get her out of the dark place shes in now. cos i mean if they remove her mother from the scenario theres no one really elisabeth can open up to and trust besides the doctors. i think they letting her (elizabeth ) think this that her mother is innocent in order to let her cope with the mental and physical devastation reaked on her by her father first. i really don't think she'll recover( or have a hard time recovering) at this present stage if they reveal her mother knew. i mean its obvious to anyone with a brain that the mother knew or suspected at least that their was something fishy abt the cellar. also why did she keep the fact away from her kids that he was a rapist maybe they had it planned all along that the only way he would stay with her is if he got to abuse the kids. i mean human curosity dictates that at least once especially when he way away in thailand that she would go and check whats going on in this mysterious cellar i mean her husband wasn't around to ban her then. i mean if it were me i can understand the talk of her being afraid of him and blah blah blah. but i mean for four weeks she doesn't check the cellar while hes away. i think she knew. also why didn't she ever suspect anything i mean he disappears to the cellar and babies appear i mean surely he would have needed to go down to the cellar get the babies first and then put the kids where they could be found (how did he manage this three times unless she was helping) what i think happened is that he would probably drug elisabeth on those days so that she wasn't aware of anything have the mom come down with him and take the kids and then voila to the outside world they claim their daughter left a grandchild. also she seemed not to be worried and not actively searching for elisabeth most mothers of kids who disappear never give up searching. also it says that he phoned her pretending to be elisabeth how could she be fooled surely she knew what he daughter sounded like. i think it was an elaborate plot so that she could hold on to her no good husband they probably even made a pact that if he was discovered he wouldn't tell anyone she was involved in exchange for helping him. i mean in the year and a half that he was away for rape why didn't she divorce him???i think they need to give him life and also in order to make sure that they learnt from the past and protect future children stop making the laws so damn good for perpertrators and charge the mom with failure to act or inform i mean she could have at least let it slip to interpol when they reported the msiing persons case that oh by the way josef has two convictions for sex crimes, and informed her daughters that way when elisabeth was abused she would have known not to be ashamed and could have gotten help at eleven i mean apparently it says that b4 elisabeth was kidnapped her father was always taking her out alone on forest trips and stuff (raping her) then the very same daughter disappears and she doesn't question anything when the three babies also appear and the cellar thing she should be charged once elisabeth recovers as well. the laws must be changed i mean this guy also got to travel i mean a rapist getting to go to thailand where there are tons of unsuspecting poor women and children who must have been easy bait for this man. also i mean the mom even if lets say she didn't know and im being generous here what sort of a mother lets her unsuspecting daughters live with a rapist?? thats a crime in itself and also i'm sure if anything happened to elizabeth he was probably planning to abuse the other daug

Ways to curb increasing kidney racket cases?
what do u think should be made to done that this kidney racket which is spread all over be stopped n how can we make hospitals nn nursing home a safer place?
ur views n intelligent views required?
good day!Ways to curb increasing kidney racket cases?
Make it legal.. we are in a free enterprise system where people allowed to sell their blood, or women are allowed to sell their eggs, men their sperm.. so why not kidneys. The middlemen need to be eliminated.Ways to curb increasing kidney racket cases?
The value of a kidney (typically $10,000) can be reduced by synthetically producing kidneys with stem cell tissue.
Also reducing kidney disease by cracking down on food additive toxins and water fluoridation.
Also putting some sort of counterfeit-proof marker on legitimately acquired kidneys, and passing laws that require hospitals only use kidneys with that marker.acne treatment

Similar non-violent and violent crime cases that result in different verdicts?
I'm expected to compare the verdicts of similar cases and am having no luck finding similar cases. Anything specific I should be looking for? Specific search terms. I'm not too familiar with the judicial system so anything will help.Similar non-violent and violent crime cases that result in different verdicts?
Attempts and conspiracies to commit violent crimes I guess could be considered non-violent versions of them. Check out the legal word ';inchoate';.Similar non-violent and violent crime cases that result in different verdicts?
where are you searching? If you go on westlaw or lexis and search jury verdicts, you can put in search terms like ';broken foot'; and get a list of verdict awards for people w/ broken feet and pick out the numbers that are different. Not sure how you would find them unless you are in that kind of data base or went to a law library where they had ';jury verdict reporters'; but you could try seeing if there are free 'jury verdict reporters'; on line or search your local paper archives for any verdicts that were publised.

How do you cite court cases in MLA format?
I am writing a paper about a lawsuit and must write it in MLA formatted style. I am wondering how do I cite court cases such as this from the court of appeals:
http://www2.bc.edu/~yen/Torts/Vanna%20White%20Koz%20ed.pdf
If you can find me a link to a page where it shows how to cite a court case, that would be great. How do you cite court cases in MLA format?
Try www.easybib.com
Supply the information it needs and it'll spit out to you the citation in MLA format. How do you cite court cases in MLA format?

apperently all you do is fill in the blanks, and submit it, then the computer does it for you, all you have to do is copy and paste....
i hope it helps!!

Is it true that a human fetus can actually protect itself from abuse from the mother in rare cases?
I cannot remember where I heard this from, but awhile ago I was told that in rare occasions like 1 out of every 8 fetus' (or something like that) that are exposed to drugs, and or alcohol while in the womb will actually come out to be smarter than the average child...if you know anything about this send me a link to a web site and refer me to a book. Thanks. Is it true that a human fetus can actually protect itself from abuse from the mother in rare cases?
the placenta will filter out a lot of toxins, but a lot will still get through to the unborn child, cigarrettes cause low birth weight and alcohol causes low intellegence, and there is a lot of research been done on that, i dont think i have ever heard of them coming out smarterIs it true that a human fetus can actually protect itself from abuse from the mother in rare cases?
Do you mean intentionally? I really doubt it.

In which cases do you translate the present progressive in English into an infinitive of a verb in Spanish?
For example, I think that in translating a phrase like ';upon leaving'; from English to Spanish, you use ';al salir de';. In what other cases would an ';-ing'; verb in English translate to the infinitive -ar, -er, or -ir (instead of the present progressive ';-iendo'; in Spanish)?
Thanks so much in advance! In which cases do you translate the present progressive in English into an infinitive of a verb in Spanish?
i don't think there are many cases like that, and i think you just have to find out when you need that specific -ing phrase. i don't really think there's a place that you can find all of them, you just find out.

In some cases of heart transplantation, the recipient may reflect the quality/character of the donor. Is it so?
I read in a book that after a successful transplantation of heart, the patient(recipient) may reflect the character of the donor. For example changing to non-veg food habit, or to mental boldness and willpower.
Is it true in all cases or with exceptions? In some cases of heart transplantation, the recipient may reflect the quality/character of the donor. Is it so?
I don't think there is any real evidence to support that. That said, I have read about different cases in various magazines where people have had transplants and have all of a sudden developed a liking for certain foods and/or have changed slightly in their character, but there is no way of really knowing if that is to do with the transplant or other factors in life.In some cases of heart transplantation, the recipient may reflect the quality/character of the donor. Is it so?
I don't know if it is true, but I sure hope so. I like the idea of some piece of my brother being out there. Some guy got his corneas, and he just loves bull-riding now, when he wouldn't touch it before. What a great thought. Or, someone who got some of his bones that suddenly starts being super nice and helpful for no apparent reason. Just a little bit more of him shining through! I do wonder if the people who received his donations feel like watching A%26amp;M play but they used to absolutely hate the game.
no.
that is categorically impossible.
the heart has nothing to do with oersonality.
they would just be same person they had before, except now they would be walking around with a donor heart in their chest.
its like if i lend you 5 dollars, you dont act like me till you pay it back..
I don't think so. If that's the case people would've never been transplanted with hearts of pigs to begin with.
yes i have heard this is true. some people who have had transplants have said they have changed.acne treatment

If that's the case people would've never been transplanted with hearts of pigs to begin with.
yes i have heard this is true. some people who have had transplants have said they have changed.
In Civil cases is compensation determined by the defendants ability to pay?
A person is trying to claim against me for a personal injury that occurred during a football match, although I was yellow carded I don't feel the incident was anything other than a unfortunate accident. I have spoke to the football clubs and my own insurers and I don't appeared to be covered for this claim against me.
If a court finds against me (I cant afford a solicitor), would the level of compensation be determined by the amount I can afford to pay??In Civil cases is compensation determined by the defendants ability to pay?
Firstly the claimants solicitor will need to know if you have insurance ie home and buildings. If you do they will sue you through the insurer.
If you do not have insurance you will be seen as a ';man of straw';. You have no assets so they will probably refuse to continue the claim against you as you cannot pay the compensation and costs if you are found liable.
The club you play for will have insurance and you should be covered by that. If they do not then they should not be playing league football. You are playing as a representative of the club and as such they are vicariously liable for your actions on the field.
I suggest you pass on the letter of claim from the claimants solicitor to your club to pass on to their insurer, you will then get proper legal advice.
The local league should also have insurance cover, you should contact them and let them know the situation. In Civil cases is compensation determined by the defendants ability to pay?
Everywhere is different. There are many factors involved in reaching a settlement. But, generally, the main determinant is the injury cost times 3. ($500 in medical bills, so the payout should be around $1500). If there was alot of emotional expense, then that would be added in too. If you live in an area that is not very wealthy then the amount will be less. Jurors who don't have alot of money will think a small payout is fair; because the small payout seems like alot to them. If the settlement is way out of the possibility for you to pay, they set up a deadline to have all of it paid by, but it's normally not more then 2 years.
Actually, if the court finds in favor of the plaintiff, the amount awarded will be determined by the injuries and medical costs related to the injury, not on what you can afford to pay. Though you were, ';yellow carded,'; it still sounds like a probable accident and par for the course during a game of football. The court may in fact find you partially liable and order you to pay a portion of any medical expenses incurred by the other player.
During sports, things happen. Tell the truth in court and that is why that person should have insurance. They could in all honesty go after you for your house, car, bank, garish your wages etc. How old are you? If you are under 18 they cant do anything to you. If they can prove the accident was not an accident then you are in deep pooh.
There is also an old saying if you really dont have anything
'; YOu cant get blood from a turnip , or water from a rock';
The level of compensation will be determined by the nature of the injuries not your ability to pay. If you are not covered by insurance you will have to pay out of your own resources.Hopever when it comes to paymeny terms your means will be taken into account and if you need time to pay you will usually get it.
No. The level of compensation is based on the damage to the plaintiff. If you injured someone and are liable, the judge or jury will then fix an amount of money designed to restore the plaintiff, to compensate him for his injuries.
Probably more about what happened and how severely someone got hurt.

What is the ';average'; realistic, normal age a cat usually will live to? Im not talking about exceptional cases?
I agree with Dreamer, and would just add that, on average, indoor cats live up to several years longer than outdoor cats. There are a lot of environmental hazards outdoors, especially if you live in a city. Also, repeat vaccinations are a lot less necessary for cats that don't go outdoors.
If you choose to keep your cat indoors, you've got to commit to monitoring your cat's weight and encouraging her to exercise and play.

15-20 years. 20-30+ years if well cared for. For a cat to die younger than 15 is unusual unless they are poorly cared for. Quality food and fresh water are the best way to ensure health. As cats age, incorporate raw or canned food into their diet to prevent kidney/liver problems (dry food is hard to process, it requires a lot of moisture from the body, and as a cat ages, it becomes harder and harder on their organs to process dry food. Switching to at least a partial raw or canned diet gives them more moisture with their food and helps alleviate the problem. You can also soak dry food in water or chicken broth before feeding.)
Also, lay off the vaccines, especially in older cats- after kitten shots, cats really don't need anything updated except rabies. Even if you do update when they're younger on things like distemper, once they hit around 10 years old, don't do it. Indoor cats just don't need the constant vaccines and it really wears down their immune systems after a while.
Teeth are a big thing too- bad teeth cause infections in the gums that get into the bloodstream and cause organ failure and early death. Make sure you're keeping their teeth clean, again, especially as they age.
Lastly, keep the weight off! Healthy cats actually look a tad thin to most people. Fat cats are prone to a huge number of life-shortening health conditions. It's actually healthier for a cat to be slightly underweight than slightly overweight. If your cat gains weight as it ages, cut back on the food or switch to low-fat.
I currently have a cat that's 11 1/2 years, and the vet says she'd never believe his age because he looks and acts so good. He gets rabies every 3 years and eats Wellness dry and canned food. I have a water fountain to help encourage drinking (many housecats don't drink nearly enough water, which again, affects their kidneys). Because he eats quality food he has no issues with dental disease. What is the ';average'; realistic, normal age a cat usually will live to? Im not talking about exceptional cases?
I would say a average age is 10-12. I have had several cats with my oldest living until he was 19. He died of kidney failure. My other cat was 17 she died of liver problems. I have 5 now ages 8,11,10,9,7. I feed them science diet. I feel that monitoring them for any problems and getting them to vets early on if they are sick plays a role in survival. :)
Like people genetics plays a major role in your cats lifespan and its breed will also influence its longevity.
Because your cat lives indoors I would say 12-15 years as an average.
My cat recently went to the vet and her labs came out great! She is turning 11 and seems to be in better shape than my first cat @ 11.
Hope this helps.
I have fed my many cats mostly store brand cat food and Purina cat chow. They mostly lived about 15-17 years, unless something unusual happened. My oldest was a healthy 19 when she got mouth cancer. After 2 surgeries, it came back and we decided to stop fighting. Love your cat and it will love you.
8-12 years with normal care, 12-16 with great care, and 16-25+ has been heard of occasionally...if you're gonna feed store brand food and do the required vet checks only, 8-12 years can be expected, barring injury or illness
Most cats in my neighborhood live until they walk into my back yard and eat a baby bird. Then they mysteriously disappear.
Average is 15-18 yrs old. My oldest one was 17 or 18. Next oldest was 15 - both died of heart attacks. My first cat was only 13 yrs old - he died of cancers.
Hmmm... About 15 not counting health problems that come with old age.
Between 14 and 16 years usually :)

Any confirmed cases of Swine Flu in North Carolina and what are the symptoms?
I live in North Carolina and i'm in middle school. No i am NOT scared about it i'm just merely curious. I'm more worried about not catching this bug at school, three people leaving home in one day feeling like they had to vomit, now that scares me more. Anyway i'm just curious so thanks for your help!Any confirmed cases of Swine Flu in North Carolina and what are the symptoms?
Yes there are cases in north carolina.
This shows the cases, and suspected cases http://maps.google.com/maps/ms?ie=UTF8%26amp;h鈥?/a>Any confirmed cases of Swine Flu in North Carolina and what are the symptoms?
In NC (Im here too) WRAL says they are investigating several cases. Other sources put the number at 20. All in Charlotte. No confirmed cases, but they say tests will be back tomorrow. No worries, we'll be fine. Tarheels are tougher than pig.. we certainly eat enough of it. LOL PS - Symptoms are just like regular flu.
in North Carolina, Swine Flu is not spreading.
Symptoms:
Fever
rash
bad bad cough
vomiting
trouble breathing or fast breathing (for children)
not interacting well

Are Russian cases important to learn at the beginning?
I just started studying Russian a couple months ago. I am moving along at a good clip and am wondering about the case system. I more-or-less understand the point of the cases and the role they play, but I'm wondering if I need to learn that right away, or if I should just focus on memorizing conversational situations for now. I am not trying to avoid learning the cases, I just want to know if they will confuse me if I learn them too early, while I am still trying to get a feel for the language. Are Russian cases important to learn at the beginning?
Case systems can be very confusing when starting to learn a language, particularly when coming from a language where they are not used ('who' and 'whom' are some of the last remnants of a case system in English).
I'd stick with learning some of the basics and maybe tackle one case at a time, until you're familiar with the declinations.
With Czech, I think the route I took was: nominative, accusative, genitive, and then locative, dative, instrumental and vocative some time after that. Are Russian cases important to learn at the beginning?
Learn them a little at a time. When you learn an expression, figure out what the cases are and why they are the ones to use. This is a combination of the natural, learn-by-imitation method of native speakers and the more rapid academic mode - which as adults we must use since we don't have years to spare just to learn a language the 'natural' way.
And good luck, cuz those Russian cases are no walk in the park. I learned them but I hated it because they're *redundant* when there is a preposition or fixed word order, and Russian is similar to English in these ways, yet English gets along fine without inflections.
PS: Notice I said *when* there is a preposition case endings are redundant. I can't change the language but I can have an opinion about it; it just seems way more efficient to learn single prepositions (with single functions) rather than case endings, which change not only by function but also by gender, number and whether the word is a noun or an adjective! You must enjoy a challenge to be any good at Russian.
Clear answer: Yes, you should learn them from the beginning.
Basically Aleksan (or what was his name?) is right. The cases are more important than the prepositions or the word order. Especially the prepositions depend on the cases they go with. For example, the preposition ';na'; can change its meaning depending on the case it goes with.
I started to learn Russian as a foreign language about five years ago and didn't pay too much attention to the cases at first. Then after a year I realized that I was kind of lost without them. And it was really hard for me to learn them at that stage. So the sooner you start learning them the better. But don't try to learn too much at the same time. I'd start with the noun-cases at first and leave the adjective-cases aside. But in the end you will have to know all of them...
So good luck then!
i dont know all i know is that they are hard to catch because they are always russian.
The word order usually doesn't matter, because of that the cases are just necessary to learn as early as possible. Yes, you can learn some phrases by heart before, but you won't be able to operate the language until you learn the cases. The wrong case will change the sence, as well as a wrong comma will do.

I was shocked to hear there are are 4000 in Hong Kong. How many cases of man bird pig flu are there in NYC, and in the US altogether?
I wasn't able to get that info from google, I must not be looking in the right place. but I did find this, and it's sounds very interesting:
';From someone who studies biology, the flu is man-made. Its made up of three different flu's: human flu DNA, bird flu DNA and pig flu DNA. A combination of all three gives you H1N1 (Swine flu). Now bird flu only affects bird and human flu only affects human. So obviously someone was playing God for the creation of more sophisticated virus DNA specifically made for humans.
Just the same way I think HIV is man-made, swine flu is very man-made.';

'; YOu cant get blood from a turnip , or water from a rock';
